Terms of Service
These terms govern every KVMFLUX rental — from a one-day Mac Mini M4 to a quarterly build node. They are written to be read, not skimmed: each clause is numbered so our FAQ and support replies can point you straight to the relevant rule.
Agreement and definitions
By creating an account, placing an order or connecting to a rented machine, you agree to these Terms of Service between you (the Customer) and KVMFLUX (the Provider). If you order on behalf of a company, you confirm you are authorized to bind that company.
- Service — remote access to dedicated Apple Silicon hardware (such as the Mac Mini M4) hosted by KVMFLUX, reachable over SSH, VNC or other supported protocols.
- Rental period — the billing cycle you selected at checkout: daily, weekly, monthly or quarterly.
- Add-on — an optional extra attached to a rental, such as Extra SSD storage, billed on the same cycle as the base machine.
Accounts and acceptable use
You are responsible for everything that happens under your account and on your rented machines. Keep your credentials and SSH keys private; if you suspect a compromise, rotate your keys and notify us by email without delay.
You agree not to use the Service to:
- run port scans, denial-of-service attacks, botnets, or any traffic intended to disrupt third-party systems;
- send unsolicited bulk email or operate open relays and proxies for abuse;
- store or distribute content that is illegal in the jurisdiction in which the platform operator is established;
- mine cryptocurrency or run sustained workloads unrelated to software development, testing or general computing that intentionally stress hardware beyond normal use;
- violate Apple's macOS software license terms, including redistributing the operating system image;
- resell or sublease access to your machine without written approval from KVMFLUX.
We may suspend a machine immediately when we detect abuse. For anything ambiguous — for example a legitimate load-testing project — ask first and we will usually find a way to accommodate it.
Billing cycles and renewals
All prices are quoted and charged in USD via Stripe. The cycle you pick at checkout matches the periods listed on the pricing page exactly; add-ons follow the same cycle as the base machine.
| Cycle | Term length | Renewal behavior |
|---|---|---|
| 1 Day | 24 hours from provisioning | Expires automatically; no auto-renewal, extend manually before expiry to keep the machine. |
| Weekly | 7 calendar days | Renews for another week unless cancelled before the renewal date. |
| Monthly | 1 calendar month | Renews monthly unless cancelled before the renewal date. |
| Quarterly | 3 calendar months | Renews quarterly unless cancelled before the renewal date. |
The rental period starts when access credentials are delivered, not when payment is made. If a renewal charge fails, we retry and email you; the machine is suspended after 48 hours of non-payment and its data may be erased 7 days after suspension.
Switching cycles — for example moving a daily rental to a monthly plan — takes effect at the next renewal. There is no penalty for switching; see our guide on choosing a rental period for the math.
Cancellation and refunds
You can cancel any plan at any time; cancellation stops future renewals and the machine stays available until the end of the paid period. Refunds work as follows:
- Provisioning failure — if we cannot deliver a working machine within 24 hours of payment, you receive a full refund, no questions asked.
- Daily rentals — non-refundable once credentials are delivered, given the short term.
- Weekly, monthly and quarterly plans — refundable within the first 72 hours after delivery if the machine has a verified hardware or connectivity defect that we cannot fix by replacement.
- Renewal charges — a renewal billed in error is refundable if you contact us within 72 hours of the charge and the machine saw no logins during the new period.
Refunds are issued to the original payment method through Stripe. No refunds are owed for suspensions caused by violations of the acceptable use rules above.
Hardware usage limits
Each plan corresponds to one dedicated physical machine. You get administrator access to macOS, but the hardware itself remains KVMFLUX property. Within your rental you may not:
- attempt to flash firmware, alter boot security settings, or downgrade macOS below the version we support for that hardware;
- circumvent network metering, spoof MAC addresses, or announce IP space not assigned to your machine;
- disable the management channel we use to reinstall or recover the machine between rentals.
Storage and network allocations are those stated on your order. Sustained full-throttle workloads that would be normal for CI builds are fine; deliberately thermal-stressing the device to induce failure is not. Machines are securely wiped and reinstalled before every new rental.
Service availability and maintenance
We aim to keep machines reachable around the clock but do not warrant uninterrupted operation. Planned maintenance is announced by email in advance whenever practical. If a hardware fault takes your machine offline, we repair or replace it; downtime that exceeds 24 consecutive hours from your fault report is credited as extra rental time on your current period.
You are responsible for backing up your own data. Machines are physical devices without redundant storage; we do not keep copies of your files, and data on a wiped or reclaimed machine cannot be recovered.
Limitation of liability
The Service is provided on an as-is and as-available basis. To the maximum extent permitted by law, KVMFLUX is not liable for indirect, incidental or consequential damages — including lost profits, lost data, missed release deadlines or the cost of substitute services.
Our total aggregate liability for any claim arising from these terms is capped at the amount you paid for the affected rental during the three months preceding the claim. These terms are governed by the laws of the jurisdiction in which the platform operator is established, and disputes fall under the exclusive competence of the courts of that jurisdiction.
Changes to these terms
We may revise these terms as the Service evolves. Material changes — anything affecting pricing rules, refunds or acceptable use — are announced by email at least 14 days before they take effect, and the version number at the top of this page is updated. Continuing to use the Service after the effective date constitutes acceptance; if you disagree, cancel before the change takes effect and clause 04 applies to any unused prepaid period.
